Terms of sale
Article 1 - Purpose
These terms and conditions govern sales of sportswear by the company SARL Kynox, located at 15 rue Saint-Léger, 31600 Eaunes.
2 - Prices
The prices of our products are quoted in euros, inclusive of all taxes (VAT and other taxes applicable on the date of the order), unless otherwise stated, and exclude processing and delivery charges.
For orders to countries other than mainland France, you are the importer of the product(s) in question. Customs duties, other local taxes, import duties or government taxes may be payable. These duties and charges are not the responsibility of SARL Kynox. They shall be borne by you and are your sole responsibility, both in terms of declarations and payments to the relevant authorities and bodies in your country. We advise you to seek information on these matters from your local authorities.
All orders, regardless of their origin, are payable in euros.
SARL Kynox reserves the right to change its prices at any time, but the product will be invoiced on the basis of the price in force at the time the order is confirmed, subject to availability.
The products remain the property of SARL Kynox until full payment has been received.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products passes to you.

The contractual information is provided in French and will be confirmed no later than when you confirm your order.
SARL Kynox reserves the right not to process a payment and not to confirm an order for any reason whatsoever, and in particular in the event of a supply issue or a problem with the order received.
Article 4 – Confirmation of your order
Any order placed on the website https://polelovers.com/  implies acceptance of these General Terms and Conditions. Any order confirmation constitutes your full and unconditional acceptance of these general terms and conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation shall constitute proof of the transaction.
You declare that you are fully aware of this.
The order confirmation shall constitute your signature and acceptance of the transactions carried out.
A summary of your order details and these General Terms and Conditions will be sent to you in PDF format via the email address used for your order confirmation.
Article 5 – Payment
By confirming your order, you are obliged to pay the price shown.
Payment for your purchases is made by credit card via the secure API Credit Agricole system.
Your card will be debited at the time of purchase.
We also accept payments via PayPal, Apple Pay and Google Pay, offering you greater flexibility in your payment options. All transactions are secure and processed via our payment service providers to ensure the protection of your banking details.
We offer payment in instalments via Alma, available in 2, 3 or 4 instalments for orders of €50 or more. However, gift vouchers cannot be paid for using this payment method.
Article 6 – Right of withdrawal
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to provide a reason or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). You are liable for the condition of the goods during this process. Any damage sustained by the product during this process may invalidate your right of withdrawal.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
The provision of services that have been fully performed before the end of the withdrawal period and where performance began following the consumer’s prior express consent and express waiver of their right of withdrawal.
The supply of goods or services where the price depends on fluctuations in the financial market beyond the trader’s control and which may occur during the withdrawal period.
The supply of goods made to the consumer’s specifications or clearly personalised.
The supply of goods liable to deteriorate or expire rapidly.
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.
The supply of goods which, after delivery and by their very nature, are inseparably mixed with other items;
The supply of alcoholic beverages where delivery is deferred for more than thirty days and where the value agreed at the time the contract is concluded depends on market fluctuations beyond the trader’s control.
The supply of audio or video recordings or computer software where these have been unsealed by the consumer after delivery.
The supply of a newspaper, periodical or magazine, except for subscription contracts for such publications.
Transactions concluded at a public auction.
The supply of digital content not supplied on a tangible medium, where performance has begun following the consumer’s prior express consent and express waiver of their right of withdrawal.
Article 7 – Availability
Our products are available whilst they are displayed on the website https://polelovers.com/  and subject to stock availability. For products not held in stock, our offers are valid subject to availability from our suppliers.
Should a product be unavailable after you have placed your order, we will inform you by email. Your order will be automatically cancelled and no payment will be taken from your bank account.
Furthermore, the website https://polelovers.com/  is not intended to sell its products in large quantities. Consequently, SARL Kynox reserves the right to refuse orders for identical items.
Article 8 – Delivery
Products are delivered to the delivery address specified during the ordering process, within the timeframe indicated on the order confirmation page.
In the event of a delay in dispatch, you will be sent an email to inform you of any potential impact on the delivery time originally indicated to you.
In accordance with legal provisions, in the event of a delay in delivery, you have the right to cancel the order under the terms and conditions set out in Article L 138-2 of the Consumer Code. If, in the meantime, you receive the product, we will refund the purchase price and the delivery costs in accordance with the terms of Article L 138-3 of the Consumer Code.
In the case of deliveries by a carrier, SARL Kynox cannot be held liable for any delay in delivery caused solely by the customer’s unavailability after several attempts to arrange a delivery time.
Article 9 – Warranty
All our products are covered by the statutory warranty of conformity and the warranty against hidden defects, as provided for in Articles 1641 et seq. of the Civil Code. In the event that a product sold does not conform, it may be returned, exchanged or refunded.
All complaints, requests for exchange or refund must be made by email within 30 days of delivery.
Products must be returned to us in the condition in which you received them, complete with all components (accessories, packaging, instructions, etc.). Delivery charges will be refunded based on the invoiced rate, and return postage costs will be refunded upon presentation of supporting documents.
The provisions of this Article do not prevent you from exercising the right of withdrawal provided for in Article 6.
Article 10 – Liability
The products offered comply with current French legislation. SARL Kynox cannot be held liable in the event of non-compliance with the legislation of the country to which the product is delivered. It is your responsibility to check with the local authorities regarding the possibilities for importing or using the products or services you intend to order.
Furthermore, SARL Kynox shall not be held liable for any damage resulting from the misuse of the product purchased.
Finally, SARL Kynox shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular service disruption, external intrusion or the presence of computer viruses.
Article 11 – Applicable law in the event of disputes
The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 12 – Intellectual Property
All elements of the website https://polelovers.com/  are and remain the exclusive intellectual property of SARL Kynox. No one is authorised to reproduce, exploit, redistribute or use for any purpose whatsoever, even in part, any elements of the website, whether software, visual or audio. Any simple or hypertext link is strictly prohibited without the express written consent of SARL Kynox.
Article 13 – Personal Data
SARL Kynox reserves the right to collect personal information and personal data relating to you. This information is necessary for the processing of your order, as well as for improving the services and information we provide to you.
It may also be passed on to companies involved in these dealings, such as those responsible for the fulfilment of services and orders for the purposes of their management, fulfilment, processing and payment.
This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the Act of 6 January 1978, you have the right to access, rectify and object to the personal information and data concerning you, directly via the website.
Article 14 – Archiving and Evidence
SARL Kynox shall archive purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerised records of SARL Kynox shall be regarded by all parties concerned as evidence of communications, orders, payments and transactions between the parties.
